PROGRAM TERMS AND CONDITIONS

Explorars, as the name suggests is a combination of the words Explore and Scholars, and is an organization that focuses on experiential learning by offering educational travel programs to students. It is deeply inspired to bring a transformation in the way children learn by exploring the world beyond their classrooms with a perfect blend of fun & learning programs designed by us with insightful advice from expert educators.

The following Program Booking Rules and Regulations are applicable for all Explorars programs with effect from 1st of August 2014. Participants who take part in Explorars programs are subject to its terms and conditions including payment & cancellation policies and program guidelines.

EXPLORARS PROGRAM COMPONENTS: ALL YOU NEED TO KNOW!

Program Director [PD]: An experienced PD will accompany participants during all programs undertaken by Explorars to ensure seamless execution, safety and to take care of their every need.

Departure and Arrival: Participants are required to reach the airport or railway station or a designated venue on time. (31/2hours prior to the scheduled time of flight departure in case of International flights, 2 Hours prior to departure for domestic flights and 90 minutes prior in case of train travel). They check-in as a group with the TI appointed by the school. Our PD will meet the participants at the departure airport. On arrival at the destination, participants complete the immigration (for International travel), collect their baggage, proceed through customs (for international travel) and to the waiting vehicles.  The beginning of a new journey can be really exciting and fun, enjoy it!

Accommodation: Accommodation is selected on the basis of safety, cleanliness, friendly staff and easy access. Participants share a room with additional participants of the same gender. Room allocation is done in consultation with the accompanying TI. This is a great opportunity to make new friends! Rooms on the same floor cannot be guaranteed.

Travel within the Destination: Travel arrangements within the destination are booked in advance. Air-conditioned coaches, trains or ferries, as required, will be available to participants as per program.

Meals:  We offer local and international cuisineswith both vegetarian and non-vegetarian options. Tasting new cuisines is essential to experiential travel and helps understanding of new cultures. Relish it! If the school/participant has any special dietary requirements, the same should be communicated at least 30 days prior to the programdeparture. The school also needs to inform the PC about any allergies to specific foods that a participant may have. While we will endeavour to accommodate dietary requirements, it may not be possible at all destinations.

Personal Expenses: Each participant should carry enough money to meet personal expenses, beverages, gratuities and for souvenir shopping. Participants will be responsible for the money they carry.  They may handover this money, with mutual agreement, to the TI for safekeeping. An international debit/cash card is also a safe option.

Travel with Others: Travelling is all about being open to new ideas, places and people. Unless the school has booked for a private journey, participants will travel with participants of other schools. This offers an affordable mechanism for small groups to travel together. An open approach allows participants to learn from each other and make new friends.

EXPLORARS PROGRAM GUIDELINES:

The rules are simple, but we ask thatparticipants adhere to them throughout program. The following program guidelines have been established for students safety:

  1. Participants are not permitted to travel anywhere unaccompanied. This includes visiting relatives and friends during the program.
  2. Participants with a medical history must carry their medication and prescriptions with them. Doctor's orders!
  3. Participants of the opposite gender are not permitted to visit each other's room.
  4. Participants are required to be respectful of their peers and the local communities in which they travel and work
  5. PPI of PD are important. Participants need to follow them throughout the program.
  6. All program activities are mandatory as we don't want any participant to miss out on any of the learning or fun!
  7. Possession of illegal substances (drugs, alcohol, tobacco, inflammable substances, arms and ammunition, etc.) is strictly prohibited.
  8. Renting of any vehicle, driving or hitchhiking is prohibited during the program.
  9. Participants will directly pay for any damage caused by them to a hotel, airline, transport company, public or private property.
  10. Participants who deliberately or unknowingly breach local laws will be solely responsible for their actions.

Program Start and End Dates: All international and domestic Explorars programs commence from the point when the participants take-off from an Indian airport, train or bus for their overseas or domestic destination and end with the touchdown of their return flight on an Indian airport or return to the Railway station or dis-embarking point for bus journeys.

PROGRAM FEE

Program fees Include the Following:

  1. a)Cost of flight tickets, trains and road transportation as included in the program
  2. b)Currently applicable taxes, subject to change
  3. c)Cost of visa as included in the program
  4. d)FOC arrangements for teachers (Teacher to Students Ratio – 1:10)
  5. e)Accompanying Explorars' Tour Director during the entire course of the trip
  6. f)Comprehensive Travel Insurance
  7. g)Accommodation as included in the program
  8. h)All meals as included in the program
  9. i)Cost of workshops as included in the program
  10. j)Orientations and excursions as included in the program
  11. k)ULeaP activities &sessions
  12. l)Entrance fees to monuments as included in the program
  13. m)Explorars' Delivery Kit
  14. n)All local and governmental stattory charges as applicable
  15. o)The funnest time ever, completely free!

What the program fee does not include:

  1. Meals than the ones mentioned in the itinerary
  2. Items of personal nature like water, soft drinks, gratuities, laundry, room service, incidentals, camera tickets etc.
  3. Extra excursions or sightseeing apart from the suggested tour itinerary
  4. Anything not specifically included above
  5. Travel for outstation participants to the city of departure.
  6. Transfer to and from airport in India.
  7. Beverages and additional meals/snacks.
  8. Surcharge owing to fluctuations in currency exchange rate.
  9. Expenses incurred due to cancellations (for example, airline, hotel, excursion cancellation, etc.), delays and rescheduling of activities that are beyond the control of Explorars
  10. Passport processing and associated fees.
  11. Additional sightseeing expenses not mentioned in the itinerary.
  12. Shore excursions on cruises.
  13. Transportation to free-time activities.
  14. Tips for bus drivers, guides, waiters, bell-boys, etc.
  15. Additional charges: Airport taxes, departure taxes, fuel surcharge, visa fee, currency exchange rates and certain surcharges are subject to change and beyond the control of Explorars
  16. Any additional charge resulting in this manner post the date of program enrollment will be passed on to the program participant, even if the entire program fee has been paid in full.

MINIMUM AGE FOR TRAVEL

Minimum age of student is determined basis nature of the program and as per mutual agreement between the Explorars Team and the School.

PEOPLE WHO DO NOT QUALIFY FOR AN EXPLORARS PROGRAM

a) Students who are not enrolled with the school undertaking the program. This includes, children of school staff, siblings of students studying in another school or ex-students.

b) Adults who are neither staff, teachers nor management of the school undertaking the program.

NAME AND ENROLLMENT FEES

PBF submitted for an Explorars program must carry the first and last name of the applicant as it appears on their passport. The non-refundable enrollment fee vide a Demand Draft/ Cash/ Cheque drawn in favour of "Planet Explorer Pvt. Ltd." – payable at New Delhi and in favour of Explorars FZ LLC for pplications from UAE, needs to be submitted to Explorars along with the completed PBF. In case any changes are requested in the submitted PBF, costs related to the same need to be paid by the concerned applicant.

MERGING OF GROUPS

The costing for an Explorars program is done on the minimum group size of paying participants. In the event that the school is unable to provide the minimum number of paying travellers before 60 days of the scheduled date of program, Explorars reserves the right to merge the school group with another school group. This ensures that two or more smaller groups are able to travel economically. In such a case there is a possibility that the two groups may vary in age. In the eventthat the minimum number is not achieved through merging groups, Explorars reserves the right to either postpone or cancel the program.

CHANGE IN PROGRAM ITINERARY

Explorars makes every effort to operate the confirmed program itinerary. However, owing to forces beyond Explorars' control changes may be required to the existing itinerary. Such changes may include restructuring the order of daily events/ activities or changing the order in which the cities on the itinerary are to be visited. On certain days, such as public holidays, some events or activities featured on the itinerary may not be possible. In such a situation, Explorars will do its best to provide suitable substitutions. In extreme cases, the program duration or the travel dates may require alteration. Explorars strives to ensure that such alterations are kept to the minimum but cannot guarantee against the same. In the event that the program duration is extended on account of flight cancellation, strikes, political unrest, inclement weather or any other reason beyond the control of Explorars, the additional expenses incurred during this period will be payable by the participants.

DOCUMENT REQUIREMENTS: INTERNATIONAL PROGRAMS

Program participants require valid travel documents with appropriate visa(s) to visit each country on the chosen itinerary. Once your program application has been accepted and processed Explorars will provide the list of documents required for the visa process. It is the participant's responsibility to provide each of these documents on time.

After receiving the documents, Explorars will facilitate the visa application process; this includes providing assistance in arranging interviews and transfer of required documents.

IMP: While we will assist the visa process, it is the visa issuing authority that holds the discretionary powers to issue or reject or withhold a visa application.

DOCUMENTS NECESSARY FOR VISA REQUIREMENT:

Following is an indicative list of possible documents required for the visa application. The actual set of documents required will depend on the countries being visited and these requirements may change from time to time.

DOCUMENTS FOR TRAVEL

a) Valid passport: The passport should be valid for at least 6 months from the date of completion of program and contain requisite blank pages for the visa/s.

b) Visa Application Form: Duly filled and signed by the parent/s and participant.

c) Photographs: 4 recent colour passport size photographs (the actual size specifications may differ depending on the country being visited).

FINANCIAL DOCUMENTS PARENT(S)

a) Last 3 years' personal income tax papers/ Challan forms.

b) Last 6 months' personal bank statements in original.

c) Last 3 to 6 months' salary slips If the parent sponsoring is employed OR Copy of Memorandum of Articles in case of self-owned business

IDENTIFICATION AND AUTHORIZATION DOCUMENTS

a) Student's school ID card or report card.

b) Copy of the birth certificate of the student.

c) ID of the parents (photocopy of any one of the following – Voter ID card, Aadhar Card, and Passport).

d) Notarised original Travel Guardian Certificate signed by both parents. The TI is the appointed Legal Travel Guardian.

VISA APPLICATION AND PROCESSING FEES

a) Explorars will provide necessary assistance in securing a visa. Visa application and all relevant documents must be submitted to Explorars 4-6 months prior to the date of program. If any document/s required for processing of the visa application is/are not submitted on time, Explorars holds the right to not process the visa application and Cancellation policy will apply.

b) The visa application fee charged by Explorars is the same as the fee charged by embassies. In addition to this amount, a non-refundable handling fee is charged. If a participant is unable to secure a visa, Cancellation policy will apply.

c) Students and their parents (when required) may be asked to present themselves for interviews with regards to their visa application. Please note that any costs incurred in travelling to and from the concerned embassy or related to the interviewshall be borne by the program participants. Visa application fee or visa application documents may change without prior notice. Since such changes are beyond the control of Explorars, the additional costs will be borne by the program participants.

d) Explorars does not provide assistance in passport application services. Participants enrolling in programs with Explorars must have a passport that is valid for a minimum of 6 months from the return date of the journey. If you apply for a passport before the program, and in the event that it is not received as per program deadline, Explorars' Cancellation policy will apply.

DEPARTURE FEES

Airline companies and airports levy a departure fee, which is subject to change without prior notice. In addition to this, local governments impose security and departure taxes which are also subject to change without prior notice. Since such changes are beyond the control of Explorars, any such additional charges will be borne by the program participants.

PAYMENT POLICY

Payment Plan

You will have two payment options:

  1. Full payment: Pay entire amount in a single transaction
  2. Monthly automated plan: You will pay a deposit (and selected travel insurance cost) at the time of booking confirmation and the balance will be divided into equal monthly payments until 45 days prior to your departure.

PAYMENT METHOD

You may make the payment for Explorars program using any of the following modes of payment.

  1. Demand Draft: Payment can be made by way of a Demand Draft drawn in favour of 'Planet Explorer Pvt. Ltd.' payable at New Delhi and in the favour of Explorars FZ LLC payable at Dubai.
  2. Cheque: Payment can be made by way of Cheque drawn in favour of 'Planet Explorer Pvt. Ltd.' Cheques will be accepted until 60 days prior to departure. After that date payment must be made through a demand draft or cash. Please Note: A dishonoured cheque carries a penalty. The amount due against a dishonoured cheque will be accepted only vide Demand Draft or cash, the sum of which should include the penalty amount.
  3. Cash: An authorized Explorars representative can receive up to Rupees One Lac per participant in cash against receipt. Cash payments larger then Rupees One Lac need to be made in person at one of the offices of Explorars. This facility is applicable for schools within NCR. A copy of PAN Card should be submitted at the time of cash payment.
  4. Bank Transfer: Through an online bank transfer (only on request).

CANCELLATION POLICY:

All cancellations need to be advised by either a registered letter, or by email. A cancellation is effective only when received in writing by Explorars from the person signing the PBF. Any new person added to the booking will be deemed to have signed the original PBF and be subject to these Booking Conditions.

a) The cancellation policy is based on when the participant cancels in relation to the date of program departure. The applicable refund will be made within 30 days of the cancellation date.

Cancellation Slab for International Programs

Period before scheduled departure within which written notification of the cancellation is acknowledged by Explorars: Percentage of cancellation charge per paying participant cancelling:
120 or more days Non-refundable portion of the enrolment fee, paid at the time of signing the PBF
Between 119 – 90 days 25% of the total program fee or non-refundable portion of the enrolment fee, whichever is higher
Between 89 – 30 days 50% of the total program fee
Between 29 – 0 days 100% program fee

Cancellation Slab for Domestic Programs

Period before scheduled departure date within which written notification of the cancellation is acknowledged by Explorars: Percentage of cancellation charge applicable per paying participant cancelling:
Between 90 – 30 days Registration Fee (Non-refundable)
Between 29 – 0 days 100% program fee

b) Please note that for certain travel arrangements e.g. many-scheduled transport providers, the cancellation charge may be higher than those mentioned above. In certain cases, a 100% cancellation fee applies as soon as the booking is made and the ticket is issued. You will be advised full details of cancellation charges at time of booking. Explorars strongly recommends you to take out insurance that includes cover against irrecoverable cancellation costs. Additionally, you will remain responsible for the full amount of your insurance premium and this will not be refunded in the event of your cancellation.

c) If any cancellation reduces the number of paying participants below the minimum number required for a particular program price (including free places), the invoice would be adjusted accordingly for all remaining group participants.

CANCELLATION ON THE PART OF EXPLORARS

a) Explorars holds the right to cancel a program when there are less than 10 full paying participants from one school or if the minimum number required torun a program are not met bymerging mutually agreeing schools.

b) Explorars holds the right to terminate a participant's program owing to misbehaviour on the program, committing offences, or causing damage to public/private property. Explorars will not be responsible for covering damages incurred by the offending participant/s, and will not offer any compensation for terminating the program.

c) Whilst Explorars will at all times endeavour to operate the program as confirmed, nevertheless, because of changing circumstances, it reserves the right to make alterations to the program both before and after any booking has been confirmed. If for any reason the details of your program have to be changed before departure, Explorars will inform you as early as possible.

d) Most changes, if necessary will be minor. Whether a change is 'significant' depends on the nature of the program and may include: alteration to the scheduled departure or return time of your flight (but not a flight delay); a change to a lower standard of accommodation; or a change of departure airport. Occasionally, we may have to make a significant change to confirmed program, in the event of which you will be offered the choice of:-

(i) Either accepting the change or,

(ii) Receiving a full refund of all monies paid, except where the change is made as a result of unusual or unforeseeable circumstances(political or social instability, inclement weather, natural disasters, acts of war, terrorist acts, incidents of violence, medical issues, public health hazards, strikes, lockouts, government instability, unusual and vast fluctuations in foreign exchange currencies, fires, and all similar events.) beyond our control, the consequences of which we could not have avoided even with all due care, which include, but are not limited to, those amounting to "Force Majeure" as described separately or where the trip is cancelled due to insufficient numbers.

If your final payment is delayed beyond the due date you will not be eligible for compensation payment and the Company will invoke conditions 3(f) and 3(g).

AIR TRAVEL

Explorars tries to book flights on major international airline that offer the shortest connection to the program destination. However, the time of travel or availability of seats may dictate that the chosen flight is not direct. Specifically, for routes on which small aircraft ply, the participants may be distributed on more than one flight.

Participants cannot be allocated specific seats prior to the flight. On a rare occasion a group may need to take an overnight flight departing the evening before the scheduled departure or need to stay overnight at a domestic or international airport. Explorars will not be held responsible for any last minute change by the airline, mechanical, weather, capacity related flight delays or airline schedules. Any expenses arising due to the above will be born directly by the program participants. It is not possible to do upgrades, stopovers, or accrue frequent flier miles on an Explorars program.

ACCOMMODATION

a) Participants will stay in tourist star/class hotel and share room with participants of the same gender. In case of a mixed group, participants from different school, but of the same gender will share a room. This can be a lot of fun and a great opportunity to make new friends!

b) Adult participants are accommodated on twin/ triple sharing basis. If groups are mixed, adults from different groups but of the same gender may share a room.

c) Individual berth or recliner is allocated during overnight train travel.

DAMAGE TO PROPERTY WHILE ON THE PROGRAM

Any intended damage caused by the participant/s while on an Explorars program is punishable by immediate termination of the offending participant/s from the program. The offending participant/s will pay for the damage caused by them and need to resolve all issues arising from such damage during the program itself. Explorars will not be held liable or responsible for the conduct of the participant/s.

FORCE MAJEURE

We regret we cannot accept liability or pay any compensation where the performance or prompt performance of our contractual obligations is prevented or affected by reason of circumstances amounting to "force majeure". Circumstances amounting to "force majeure" include any event which we or the supplier of the service(s) in question could not even with all due care, foresee or forestall such as (by way of example and not by way of limitation) political or social instability, inclement weather, natural disasters, acts of war, terrorist acts, incidents of violence, medical issues, public health hazards, strikes, lockouts, government instability, unusual and vast fluctuations in foreign exchange currencies, fires, and all similar events.

COMPLAINTS PROCEDURE & DISPUTE SETTLEMENT

If you have a complaint about any service provided by us, please instantly report it to the PC or CPD in writing, depending on the stage of your program, so that immediate action can be taken to resolve the matter. In a case that requires Explorars to perform an investigation, we will revert within 30 days of the complaint being registered with us.

Any dispute concerning the Terms & Conditions and/or rules and regulations concerning the program, the literature concerning the program and/or the program itself, shall be resolved solely and exclusively within the jurisdiction of the courts of Delhi (for programs undertaken for schools in India), and competent courts of the UAE (for programs undertaken for schools in the UAE).

LIABILITY

(a) Our contracts with hotels and carriers provide for the allocation of rooms or seats to us. Your booking will normally be made within those allocations but no specific rooms or seats can or will be confirmed. However, we accept responsibility for ensuring that all component parts of the program, which you book with us, are supplied to you as described and to a reasonable standard. We have taken all reasonable steps to ensure that proper arrangements for all the programs have been made and that the suppliers of the various services, which will be provided for you, are efficient and reputable. The services and facilities included in your program will be deemed to be provided with reasonable skill and care if they comply with any local regulations that apply. We accept responsibility for the acts and omissions of not only our own employees but also of our suppliers, sub-contractors, representatives and/or agents provided they were at the time acting within the scope or course of their employment, agency or contract of supply. Our liability in all cases will be limited in accordance with and/or in an identical manner to the contractual terms of the companies that provide the transportation for your travel arrangements. We are to be regarded as having all benefit of any limitation of compensation contained in these or any conventions.

(b) When you travel by air or by sea, your journey may be subject to certain international conventions such as the Warsaw Convention, Montreal Convention or Athens Convention. You agree that the transport company's own 'Conditions of Carriage' will apply to you on that journey. When arranging this transportation for you, we rely on the terms and conditions contained within these international conventions and those 'Conditions of Carriage'. You acknowledge that all of these terms and conditions form part of your contract with us as well as with the transport company. The provisions of the Warsaw Convention1929 (as amended) concerning the carriage of passengers and their luggage by air, and the airlines' conditions of carriage, may apply to you and your party during your flight, and during boarding and disembarkation. These provisions and conditions may limit or exclude liability for death or personal injury, or loss of or damage to luggage, and may make special provisions for valuables.

Conditions of Carriage & International Conventions

In the case of sea travel the provisions of the Athens Convention 1974 relating to the carriage of passengers and their luggage by sea may apply. This Convention and the sea carriers' conditions of carriage may continue to apply to you and your party throughout your stay on board the ship, and during boarding and disembarkation. This Convention presumes that your baggage has been delivered undamaged unless you give full written details to the carrier

(1) In the case of apparent damage, before you disembark from the ship or the baggage is redelivered to you; or (2) In the case of damage which is not apparent or of loss, within 15 days of disembarkation or from the time when the baggage should have been redelivered to you. The Athens Convention, and the carriers' conditions of carriage, may limit or exclude liability for death or personal injury, or loss of or damage to luggage, and make special provisions for valuables.

CONDUCT & BEHAVIOUR

If the behaviour of any participant is considered likely to cause offence, danger, damage or distress to others, we reserve the right at our reasonable discretion, to cancel or terminate a program completely. If for example any airline pilot, accommodation owner or manager, or senior member of our staff, considers that the behaviour is unacceptable they are authorised to terminate a holiday wherever and whenever necessary.

If this sort of situation arises, our responsibility for your program will cease and we will not be obliged to cover any expenses which may be incurred by the party concerned and neither will we consider or accept any claims for compensation or refunds whatsoever. You are responsible for the cost of any damages you cause to your accommodation or its contents during your stay. These charges must be met by you and may have to be paid locally. If you are affected by any condition, medical or otherwise, that might affect your or other people's performance while on the program; you must advise us of this at the time of booking.

SPECIAL REQUEST

We do our best to meet any special requests made by you and to pass these on to the appropriate persons provided they are clearly noted on the PBF.

DEVELOPMENT WORK

It is often very difficult to predict when building work or development may begin in any accommodation as such things usually occur without notice. If we become aware of any such developments in your accommodation which could cause you significant disturbance or inconvenience, we will do our best where practical, to advise you.

DISABLED PASSENGERS

We do what we can to cater for as many participants as possible, however we feel that we should point out that whilst we have accommodated groups with special needs we are not specialists in catering for the disabled or those with special needs or with serious medical conditions. If any participant suffers from a disability or serious illness, you must contact your doctor and our office for advice before booking.

PASSPORTS & VISAS

(a) It is your responsibility to ensure that you have the correct passport and visas to gain access to any country/region included in the program you purchase from us. If you fail to do so, we have no liability to you for any cost, loss or damage, which you suffer, nor will we refund you the cost of any unused portion of your travel arrangements.

(b) If you need to obtain a new passport you should do so in good time. This normally takes about 4 weeks by post, but this time may vary depending upon which passport office you apply to and the time of year. Before travelling you must possess a passport, which is valid for at least 6 months at the end of your trip. If you apply for a passport before the program, and in the event that it is not received as per program deadline, Explorars' Cancellation Policy will apply. Explorars does not provide assistance in passport application services.

(e) Students and their parents (when required) may be asked to present themselves for interviews with regards to their visa application. Please note that any costs incurred in traveling to and from the concerned embassy or any costs related to the interview (if any) shall be borne by the program participants. Visa application fee or visa application documents may change without prior notice. Since such changes are beyond the control of Explorars, the additional costs will be borne by the program participants.

LOST BELONGINGS

Explorars will not be responsible for the loss of any personal belongings of the participants. Passports, airline ticket and any other such documents are the sole responsibility of the participants. Any kind of damage to luggage or any such property is not the responsibility of Explorars' staff. Better safe than sorry!

TEACHERS/ SCHOOL STAFF RESPONSIBILITIES

During the program the TI appointed by the school authorities shall be directly responsible for the actions of the participants. It is up to the TI to be responsible for the good conduct, discipline, safety and well-being of the participants and ensure that there is no consumption of forbidden substances, tobacco, alcohol, etc. Allowing participants to use the swimming pool or the beach is the decision of the TI and accompanying teacher/s.
